Terms of Service

1. Acceptance of Terms

Surface is a product of Tetrahedron LLC. By accessing or using Surface (“the Service”), operated by Tetrahedron LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Surface is an AI-powered 3D design platform purpose-built for vehicle wraps and out-of-home (OOH) advertising. The Service provides tools for designing vehicle wraps and other physical media, including 3D surface mapping, AI-assisted texture generation, multi-panel UV editing, and print-ready file export.

Certain customers may purchase a one-time 3D integration service to adapt a custom vehicle model for use within the platform. Delivery of this integration constitutes full fulfillment of that engagement. No ongoing obligation to modify, extend, or maintain the integration is implied unless separately agreed to in writing.

3. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate and complete information during registration.

4. Credits and Billing

Certain features of the Service, including AI image generation, require the purchase of credits. Credits are purchased in advance and consumed upon use.

• Credits are non-refundable. Purchased credits have no cash value and will not be refunded under any circumstances, including account termination, except where required by applicable law.
• Credits automatically refunded in the event of a generation failure caused by a platform or provider error.
• Credits do not expire while your account remains active.
• One-time integration fees are non-refundable once work has commenced.

5. User Content & Intellectual Property

You retain all rights to designs, files, and content you create using Surface. We do not claim ownership of your content. By using the Service, you grant us a limited license to host and process your content solely to provide the Service to you.

Your content — including prompts, reference images, and uploaded logos — is never used to train or improve AI models. See our AI Governance Framework for full details.

Surface, its logo, and all related marks are trademarks of Tetrahedron LLC. You may not use our branding without prior written consent.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer or compromise the Service
• Distribute malware or interfere with other users
• Resell or redistribute access to the Service without authorization
• Upload content that infringes on third-party intellectual property rights
• Abuse, harass, or make unreasonable demands of Surface3D personnel

We reserve the right to determine, in our sole judgment, whether use of the Service is consistent with its intended purpose. Accounts that we determine are being used in a manner that is inconsistent, abusive, or untenable may be suspended or terminated without specific cause being required.

7. No Obligation for Custom Accommodations

Surface3D is a standardized platform. We have no obligation to build custom features, make platform modifications, or provide bespoke technical accommodations for any individual customer unless explicitly agreed to in a separate signed Statement of Work (SOW).

Feature requests and product feedback are welcome at support@surface3d.ai but do not constitute a commitment to build or deliver any specific functionality.

8. Data Security & Privacy

All user data is kept secure and private. We implement industry-standard security measures to protect your personal information and design files. We do not sell, share, or distribute your data to third parties except as required to operate the Service or as required by law. For full details, see our Privacy Policy and Trust & Security page.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any loss resulting from service interruptions. For our uptime commitments, see our Service Level Agreement.

10. Termination

Either party may terminate the service relationship at any time.

• Termination for convenience: We may suspend or terminate any account with 30 days written notice, for any reason or no reason.
• Termination for cause: We may suspend or terminate any account immediately and without notice for violation of these Terms, non-payment, abuse, or conduct we determine in our sole discretion to be harmful to the Service or its users.
• Effect of termination: Upon termination, your right to access the Service ceases immediately. Unused credits are non-refundable. You may request an export of your data within 30 days of termination.
• Customer termination: You may cancel your account at any time. Cancellation does not entitle you to a refund of unused credits or integration fees.

11. Limitation of Liability

To the maximum extent permitted by law, Tetrahedron LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, loss of data, or business interruption.

Our total cumulative liability to you for any claim arising from or related to the Service shall not exceed the total amount you paid to Tetrahedron LLC in the twelve months preceding the claim. This cap applies regardless of the form of action or theory of liability.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Texas.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance of the revised Terms.
